1. Scope
These General Terms and Conditions (GTC) apply to all contracts between the client and Maximilian Judith (hereinafter referred to as "the Contractor").
2. Subject Matter of the Contract
The Contractor undertakes to provide the services commissioned by the client in the field of media production.
The type and scope of services are determined by the respective planning and the order confirmation.
3. Scope of Services
The scope of services includes:the agreed number of preparation daysshooting daysprocessing of the materialdelivery of the finished material in the agreed format and within the specified deadlineAny objects or materials required for the project must be provided by the client.
4. Client’s Cooperation Obligations
The client undertakes to provide all necessary information and materials in a timely manner.
In the event of delays due to missing or late cooperation, the Contractor shall not be liable for missed deadlines.
5. Payment Terms
The costs are determined by the order confirmation. The order can be confirmed in writing or orally.
The calculation is based on the scope and effort of the project.Upon commissioning, a prepayment of 30% of all external and incidental costs is due.
In case of late payment, handling fees of up to 15% may be charged. Additional costs due to changes in the order are borne by the client.
Unplanned extra work may amount to up to 10% of the Contractor’s fee. Invoices are to be paid within the stated term without any deductions.
No discount (skonto) is granted. Any artist social security contributions under the KSVG are to be paid by the client in addition.
6. Data Handling and Archiving
The Contractor is not obliged to permanently archive media material.
Original files remain with the Contractor and will only be released upon separate written agreement.
7. Working Hours and Overtime
Regular working hours are up to 10 hours including breaks. From the 11th hour onwards, the following surcharges on the hourly rate apply:11th–12th hour: +50%13th–14th hour: +100%
8. Cancellation, Withdrawal and Risk
In the event of cancellation, already incurred costs are charged at 100%. Up to 7 days before the start of production, up to 50% of the fees may be charged.
From 2 days before production, 100% of the fees are due. In the event of withdrawal for important reasons, no claims for damages arise.
Weather and currency risks are borne by the client.
9. Usage Rights
The Contractor retains all copyrights. Usage rights are only transferred to the agreed extent and only after full payment has been made.
Transfer to third parties is not permitted without consent. The Contractor may use the material for self-promotion purposes.
10. LiabilityThe Contractor is only liable for intent and gross negligence. Liability is limited to the contract value.
The client shall indemnify the Contractor against claims by third parties.
11. Data Protection
Personal data will be treated confidentially and used only within the scope of the contract.
Obtaining any necessary GDPR consent from involved persons is the responsibility of the client.
12. Final Provisions
Amendments must be made in writing. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
